Terms of service

Welcome to Fitnesskar. These terms of service (the "Terms") are a legally binding agreement between you (the "User") and Fitnesskar ("we", the "Company") that governs your use of the Fitnesskar mobile application, the website and all related services (together, the "Services").

By accessing or using our Services you confirm that you agree to these Terms. If you do not agree with any part of these Terms, please do not use our Services.

We reserve the right to change these Terms at any time. Important changes will be announced through the application or by email. Continued use of the Services after a change takes effect means you accept the new Terms.

To use the Fitnesskar Services, you must:

• Be at least 13 years old (anyone under 18 must have the consent of a parent or legal guardian)
• Have the legal capacity to enter into a contract
• Provide accurate and complete information when registering
• Comply with the laws and regulations that apply where you live
• Have no history of a suspended or blocked Fitnesskar account

Creating an account: Some features require an account. You are responsible for keeping your login details confidential.

Account security: You undertake to:

• Choose a strong, unique password
• Not share your login details with anyone else
• Tell us immediately if you notice any unauthorised access
• Keep your account information up to date

Responsibility: You are responsible for all activity that takes place under your account.

Fitnesskar provides the following services:

• Access to an exercise database of more than 2,400 exercises
• Ready-made and customised workout routines
• Tools for tracking progress and performance
• Educational content on strength training and fitness
• The ability to create personalised workout routines

We reserve the right to change, suspend or discontinue any part of the Services at any time.

Premium subscription: Some advanced features require a premium subscription.

Pricing:

• Prices are shown in the application and may change
• Price changes do not affect active subscriptions
• Payments are processed through trusted payment gateways

Automatic renewal: Subscriptions renew automatically unless they are cancelled before the end of the period.

Refund policy:

• For in-app purchases made through the App Store or Google Play, the refund policy of that platform applies
• For direct payments, a refund request can be considered up to 7 days after purchase
• A refund is not possible where the Services have been used substantially

No medical advice:

• Our content is for educational and informational purposes only
• Consult your doctor before starting any exercise programme
• People with specific medical conditions should train under the supervision of a specialist

User responsibility:

• You are responsible for assessing your own physical abilities
• If you feel pain or discomfort, stop exercising immediately
• Use standard, safe exercise equipment
• Fitnesskar accepts no responsibility for injuries caused by exercises performed incorrectly

Ownership: You own the content you create (personal workout routines, notes and so on).

Licence to use: By submitting content, you grant us a non-exclusive, royalty-free, worldwide and transferable licence to use, display and distribute that content for the purpose of providing the Services.

Prohibited content: Submitting the following content is prohibited:

• Unlawful, abusive or hateful content
• False or misleading medical information
• Content that infringes the intellectual property rights of others
• Malware or malicious code
• Unauthorised advertising or spam

Our rights: All intellectual property rights in the Services, including but not limited to:

• Software, code and algorithms
• User interface and user experience design
• Educational content, videos and images
• Workout routines designed by us
• Trade names, logos and trademarks

belong to Fitnesskar and may not be used without written permission.

Restrictions: You may not:

• Copy, modify or reverse-engineer the Services
• Use the content for commercial purposes
• Use bots or automated tools to extract data

You undertake not to:

• Break local or international laws and regulations
• Impersonate anyone or provide false information
• Attempt to gain unauthorised access to systems
• Disrupt the operation of the Services
• Use the Services to harass others
• Share your account with others
• Circumvent technical or security restrictions

Termination by you:

• You can delete your account at any time through the application settings or the account deletion page
• Subscriptions are cancelled through the App Store or Google Play

Termination by us: We may suspend or block your account in the following cases:

• A breach of these Terms
• Suspicious or fraudulent activity
• A request from the legal authorities
• Prolonged inactivity

After termination: All licences to use the Services end, and your data is processed in accordance with the privacy policy.

Services provided "as is": The Services are provided without any express or implied warranty. We do not guarantee that:

• The Services will be uninterrupted or error-free
• Any particular result will follow from using the Services
• The content is completely accurate and up to date

Limitation of liability: To the maximum extent permitted by law, Fitnesskar is not liable for:

• Indirect, consequential or punitive damages
• Loss of data or profit
• Physical injuries resulting from exercise
• The actions of third parties

You agree to indemnify Fitnesskar, its directors, employees and partners against any claim, damage, cost and liability arising from:

• Your breach of these Terms
• Your infringement of the rights of third parties
• Misuse of the Services
• Content you submit

and to hold them harmless from all such claims.

Governing law: These Terms are interpreted and enforced under the laws of the Islamic Republic of Iran.

Dispute resolution:

• If a dispute arises, an amicable resolution will be attempted first
• If no agreement is reached, the dispute will be referred to arbitration
• The final authority will be the competent courts of Tehran

Our Services may include links to, or integrations with, third-party services:

• The Apple App Store and Google Play Store
• Payment gateways
• Analytics and statistics services
• Social networks

We accept no responsibility for the services, policies or conduct of third parties.

Entire agreement: These Terms, together with the privacy policy, form the entire agreement between you and Fitnesskar.

Severability: If any part of these Terms is found to be unenforceable, the remaining parts stay in full force.

No assignment: You may not transfer your rights or obligations without our written consent.

No waiver: Our failure to enforce any right does not mean we waive that right.
